“We expected it,” French LaLiga lawyer Juan Branco told AFP. “It was a technical resource, what matters is the substantive penalty” which, according to him, could intervene “before the end of the 2022/2023 season”.

However, Branco explains that the rejection of the provisional measures is due to the fact that, in the opinion of the court, the urgency has not been sufficiently justified and advanced that they “evaluate” the possibility of presenting a new request more in detail to justify his request. .

The complaint concerns the accounts presented by PSG to the French Professional Football League (LFP), which authorized Kylian Mbappé’s new contract, and the validation of this accounting balance by the LFP and its National Control and Management Department. (DNGC).

According to Branco, PSG did not respect the “criteria and indicators provided for by the regulations of the LFP and the DNCG as well as those dictated by UEFA” through the rules of financial fair play.

According to the French lawyer, this situation has “generated a significant and direct prejudice for the complainant, LaLiga”. He added that, in the opinion of the Spanish League, PSG’s accounts “have no accounting basis and are not well analyzed according to UEFA’s criteria on financial ‘fair play’. This allows the PSG to override these rules with the complicity of the LFP and the DNGC”.

Branco accuses PSG of having presented “distorted balance sheets, deliberately fanciful provisional budgets” and of having “manufactured the system of ‘related parties’ put in place with sponsors directly dependent on the Qatari entity”, like the country tourist office.

“This situation structurally affects the possibility of fair competition without distortions within the internal market of the European Union (…) and the principles of sporting fairness”, explains the lawyer.

This is the first step in the strategy of LaLiga and its lawyer. “The LFP should never have validated Mbappé’s contract. The DNCG should have warned PSG of the non-compliance with the rules of financial fair play at national level but also at European level”, he believes.
